1. Introduction and Scope

1.1. This Privacy Policy explains how Rapid Diesel Repair, LLC, a California limited liability company, doing business as Rapid Diesel Repair (“Rapid Diesel,” “we,” “us,” or “our”), collects, uses, shares, and protects personal information.

1.2. It applies to information we collect through our website at www.rapiddieselca.com (the “Website”), phone calls, text messages, email, social media, our shop at 251 Kettering Dr, Ontario, CA 91761, mobile and roadside service calls, towing, and job applications (together, the “Services”).

1.3. This Policy is written to meet the California Online Privacy Protection Act (CalOPPA), California’s “Shine the Light” law, the federal CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and California’s call recording and bot disclosure laws. We also voluntarily describe the rights provided by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), and we will honor those rights for all customers whether or not the CCPA legally applies to our business.

1.4. By using the Website or Services, you acknowledge that you have read this Policy. Our Terms of Service, available at rapiddieselca.com/terms, also apply.

1.5. We do not sell your personal information for money. We never sell or share information about anyone we know is under 16. We do not use sensitive personal information to infer characteristics about you. If our Website uses advertising cookies (such as Google Ads conversion or remarketing tags), that may count as “sharing” under California law, and you can opt out at any time as explained in Section 5.

2. Information We Collect

We collect only what we need to serve you, get paid, keep records the law requires, and protect our business. In the last 12 months we have collected the categories below.

We do not knowingly collect biometric data, precise location from your device without your permission, Social Security numbers from customers, or health information.

3. How We Use Your Information

3.1. Business purposes. We use personal information to:

  • provide estimates, diagnose, repair, inspect, tow, and service Vehicles;
  • get and document your authorization for work, as the California Automotive Repair Act requires;
  • process payments, issue invoices and receipts, collect balances, and enforce liens;
  • schedule appointments and dispatch mobile and roadside service;
  • send service updates, pickup notices, and payment reminders;
  • prepare inspection reports and compliance records for DOT, BIT, and CARB purposes;
  • handle warranty claims, complaints, and disputes;
  • review job applications;
  • improve our Website, Services, and customer experience;
  • send marketing messages, only where you have consented or the law allows, with an easy way to opt out;
  • detect and prevent fraud, payment scams, theft, and security incidents;
  • comply with laws, tax rules, subpoenas, and government requests, and protect our legal rights.

3.2. Call recordings. Calls may be recorded. We tell you at the start of a recorded call, as California Penal Code Section 632 requires. We use recordings to confirm repair authorizations and payments, train staff, resolve disputes, and improve service. If you do not want to be recorded, tell us and we will offer another way to communicate.

3.3. Card payments over the phone and online. When you pay by card over the phone, authorized staff enter your card information directly into our PCI-compliant payment processor. We do not write down, store, email, or text full card numbers or security codes. Online payments go directly to our payment processor. We keep only the last four digits, card type, amount, and confirmation number for our records.

3.4. Zelle and Cash App. When you pay by Zelle or Cash App, we receive the sender’s name, handle or linked phone or email, amount, and memo. Those companies and your bank also collect information under their own privacy policies. We will never ask you by text, email, or social media to send money to a different account. If you get such a request, call us at (909) 701-8755.

3.5. Automated and AI assistants. We may use automated or AI-powered tools to answer calls, take messages, transcribe voicemails, schedule appointments, and respond to messages. These tools will identify themselves as automated, as California law requires. Information you give them is used for the same purposes listed above and is processed by our technology vendors under contracts that limit their use of it. We do not use AI tools to make decisions that produce legal or similarly significant effects about you, such as denying you service, without human review.

3.6. Text messages. If you opt in to texts, we use your mobile number to send the messages you agreed to. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. We do not sell, rent, or share mobile numbers or text opt-in consent with any third party or affiliate for their marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except the service providers that help us deliver messages.

3.7. Email. You can unsubscribe from marketing emails at any time using the link in the email. We will still send service and billing emails.

4.1. Service providers. Our service providers may use your information only to perform services for us, under written contracts that restrict their use of it and require them to protect it.

4.2. Legal and safety reasons. We may disclose information to comply with a law, subpoena, court order, or lawful government request; to enforce our Terms, liens, and invoices; or to protect the rights, property, or safety of our customers, employees, the public, or us.

4.3. Business transfers. If we sell, merge, or reorganize our business, personal information may be transferred to the new owner, who must honor this Policy for information collected under it.

4.4. With your consent. We share information for other purposes only with your permission.

4.5. No selling. We do not sell personal information for money or anything of value, other than any “sharing” through advertising cookies described in Section 5, which you can opt out of.

5. Cookies, Tracking, and Your Choices

5.1. What we use. Our Website may use cookies, pixels, tags, and similar technologies to make the site work, remember your preferences, measure traffic, and measure and improve our advertising. These may include tools from Google (such as Google Analytics, Google Ads, and Google Tag Manager), Meta (such as the Meta Pixel for Facebook and Instagram), Microsoft (such as Microsoft Advertising and Bing), and other analytics, advertising, social media, call tracking, chat, and scheduling providers we may use now or add in the future. Some of these tools may collect information about your activity on our Website and use it to show you our ads on other sites and apps.

5.2. How to opt out.

  • Use the “Your Privacy Choices” or “Do Not Sell or Share My Personal Information” link in our Website footer, or email ap@rapiddieselca.com.
  • Global Privacy Control (GPC): We treat a GPC signal from your browser as a valid request to opt out of sale and sharing for that browser.
  • Block or delete cookies in your browser settings. Some site features may not work without them.
  • Manage ad preferences directly with each provider: Google (adssettings.google.com and tools.google.com/dlpage/gaoptout), Meta (the Ad Preferences section of your Facebook or Instagram settings), and Microsoft (account.microsoft.com/privacy/ad-settings). You can also use industry opt-out tools at optout.aboutads.info and optout.networkadvertising.org.

5.3. Do Not Track. Browsers’ “Do Not Track” settings have no common industry standard, so our Website does not respond to them. We do honor GPC signals as described above.

6. How Long We Keep Information

We keep personal information only as long as needed for the purposes in this Policy, including legal, tax, and record-keeping requirements, then securely delete or de-identify it.

7. How We Protect Information

7.1. We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. These include PCI-compliant payment processors, access limited to staff who need it, password protection and multi-factor authentication on business accounts, encrypted website connections (HTTPS), and secure storage of paper records.

7.2. No system is 100% secure. We cannot guarantee the security of information sent over the internet or by text message. Never send full card numbers, bank account numbers, or passwords by text, email, or website form.

7.3. If a data breach affects your personal information, we will notify you and any required authorities as required by California Civil Code Section 1798.82 and other applicable laws.

7.4. Third-party sites. Our Website may link to other sites, such as review platforms, maps, social media, and payment pages. Their privacy practices are governed by their own policies, not this one.

8. Your California Privacy Rights

8.1. Your rights. California residents have the right to:

  • Know and access the categories and specific pieces of personal information we collected about you, where it came from, why we use it, and who we disclosed it to;
  • Delete personal information we collected from you;
  • Correct inaccurate personal information;
  • Portability, meaning a copy of your information in a usable format;
  • Opt out of the sale or sharing of your personal information;
  • Limit the use of sensitive personal information (we already use it only for permitted purposes);
  • Not be discriminated or retaliated against for exercising any of these rights. We will not deny service, charge different prices, or give a lower quality of service because you exercised your rights.

8.2. How to make a request. Call (909) 701-8755, email ap@rapiddieselca.com with the subject line “Privacy Request,” or mail us at the address in Section 15.

8.3. Verification. To protect you, we will verify your identity before acting on a request to know, access, delete, or correct. We may ask you to confirm information we already have, such as your name, phone, invoice number, or Vehicle VIN. We will not ask for more than we need, and we will use it only for verification.

8.4. Authorized agents. You may use an authorized agent. We may require signed written permission from you and may ask you to verify your identity directly with us.

8.5. Our response. We will confirm receipt within 10 business days and respond within 45 calendar days. If we need more time (up to 45 more days), we will tell you why. Requests are free unless they are excessive or repeated.

8.6. Limits on deletion. We may keep information when the law allows, including to complete a transaction, honor a warranty, enforce a lien or collect a balance, keep records required by the Automotive Repair Act, DOT, tax, or employment laws, detect fraud, or defend legal claims. If we deny a request, we will explain why.

8.7. Appeals. If you disagree with our response, reply to our response and ask for a review. A different person at our company will review it and respond within 45 days.

9. California “Shine the Light”

Under California Civil Code Section 1798.83, California residents may ask once a year whether we disclosed personal information to third parties for their own direct marketing in the prior year. We do not disclose personal information to third parties for their direct marketing purposes. You may still send a request to the contact information in Section 15.

10. Job Applicants and Workers

If you apply for a job with us, we use your application information to evaluate you for employment, check references and licenses, comply with employment laws, and keep required hiring records. We do not ask about criminal history before a conditional job offer, as California’s Fair Chance Act requires. Applicants and workers have the same California privacy rights described in Section 8, subject to employment-law exceptions.

11. Children’s Privacy

Our Website and Services are meant for adults and businesses. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.

12. Visitors Outside California

Our Services are offered in Southern California. If you live in another state that gives you privacy rights, you may contact us using Section 15 and we will honor your request as required by your state’s law.

14. Changes to This Policy

We may update this Policy from time to time and will review it at least once a year. We will post the updated Policy on this page with a new “Last Updated” date.
